1 Appellant was arrested by an officer of the Oklahoma City police department, upon reasonable grounds to believe that plaintiff was operating a motor vehicle upon the public highway while under the influence of alcohol. Immediately after arresting Appellant, the officer asked him to submit to a chemical test, either breath or blood, to determine the alcoholic content of his blood. Appellant refused the request, and was denied the opportunity to consult with counsel before deciding whether or not to submit to either test.
